What is Data Protection Law?
Data protection laws govern the handling of data by companies and other entities in their day-to-day business activities. As our world becomes more digitized and globally connected, more and more data is generated every day. Various data protection laws have been adopted to adequately protect such data. In Europe in particular, the GDPR uniformly regulates the management of personal data.
Focus Areas of Data Protection Law
Data protection is legally regulated by a complex structure of various European, national and international regulations. The focus is on the data protection rights of data subjects and the corresponding data protection obligations of companies. Since May 2018, data protection law at the European level has centered on the GDPR.
This is the first general data protection law that harmonizes the legal framework across Europe. It is also important beyond the borders of Europe. Nevertheless, national regulations are still relevant in some areas, such as the new German Federal Data Protection Act (BDSG) or the Italian Personal Data Protection Code.
Other accompanying regulations such as the ePrivacy Regulation also add to the complexity of data protection rules for companies.
